Check if you can get married or form a civil partnership

You need to check if you are both eligible to get married or form a civil partnership before you can give notice.

You can get married or form a civil partnership in England and Wales if you:

  • are both over the age of 18
  • are not already married or in a civil partnership
  • not closely related
  • both live in England or Wales
  • are a British or Irish Citizen 

If you or your partner are not a British or Irish Citizen you can get married or form a Civil Partnership if:

  • you have indefinite leave to remain in the UK
  • you have settled or pre-settled status under the EU Settlement Scheme  
  • you applied to the EU Settlement Scheme on or before 30 June 2021

Evidence of your Indefinite Leave to Remain or an EUSS Share Code would need to be provided at the time of giving Notice. 

If you or your partner do not meet the criteria above or are unable to provide the necessary evidence of status, you may still be able to marry or form a civil partnership. Please contact us for advice.
